Ndebugre Sues Bawku West Assembly

A legal practitioner and former Member of Parliament (MP) for Zebila, Mr John Ndebugre, has issued a Writ of Summons at the Bolgatanga high Court on behalf of Mrs Sophia Awinpoka Ndebugre against the Attorney-General, the Bawku West District Assembly and Mrs Beatrice Atogisinge Adu-Pam in connection with the Ghana School Feeding Programme (GSFP). In a statement of claim, Mr Ndebugre stated that Mrs Ndebugre is a business-woman residing at Zebilla and wife of the former Peoples National Convention (PNC) MP of the Fourth Republic for the Zebilla Constituency, and Mrs Aduk-Pam is a housewife and wife of the current Presiding Member (PM) of the Bawku West District Assembly. That by a letter dated December 15, 2008, Mrs Ndebugre was appointed caterer under the Ghana School Feeding Programme at Winneba by the Bawku West District Assembly which she duly accepted. The statement said when Mrs Ndebugre prepared herself to commence work, she was advised by the Co-ordinating Director of the Bawku-West District Assembly to hold on, subsequent to which her appointment as a caterer was withdrawn by a letter dated March 4, 2009. Mrs Ndebugre claims her removal as caterer is based on allegations by the PM and some of his political associates that she and her husband hold political views different from the President and the National Democratic Congress (NDC). She contends that removing her as caterer under the GSFP and replacing her with Mrs Aduk-Pam on the grounds that she and her husband belong to a different political party constituted a violation of her fundamental human right to freedom from discrimination as enshrined in Article 17(2)(3) of the 1992 Constitution. She is, therefore, seeking an order revoking or setting aside the letter withdrawing her appointment as caterer and revoking the appointment of Mrs Aduk-Pam as the substantive caterer. In addition, she is seeking an order of injunction restraining Mr Aduk-Pam from acting by herself out or performing the functions of caterer at Winneba under the GSFP and further seeking general damages for the violation of her fundamental human rights from discrimination under the 1992 Constitution.
